Austria: one of the strongest jurisdictions for player claims

Austrian courts have generally let residents reclaim losses from operators without the required licence β€” but winnings from illegal operators can also be reversible.

Austria has been one of the strongest jurisdictions for gambling loss claims, particularly against online casinos. Austrian case law has generally allowed Austrian-resident players to reclaim losses from online gambling operators that lacked the required Austrian licence.

Void both ways

Austria is stricter in one notable respect. Because an illegal gambling contract can be treated as void in both directions, there have also been cases where players had to return winnings they received from illegal operators. The Austrian Supreme Court has held that, without a licence, gambling contracts are absolutely null and void and must be reversed both ways.

Where harm is treated as occurring

A 2026 CJEU case, Wunner (C-77/24), also matters for Austria. Broadly, it indicated that where an Austrian player sues over unlawful online gambling, the harm can be treated as occurring where the player is resident and played β€” not simply where the operator is based. That can make it easier to bring a claim in the player's home courts.

The argument in a nutshell

If the operator lacked the Austrian licence, the gambling may be void and the player can often reclaim net losses β€” though winnings may also be reversible in some situations.
