Germany is one of the largest markets for gambling loss recovery. German courts have handled many claims against online casino and sports-betting operators that held, for example, a Malta licence but not the German licence their offer actually required.
Sports betting
On sports betting, Germany's Federal Court of Justice referred questions to the CJEU but indicated that offering sports betting without a German licence can, in principle, breach Section 134 of the German Civil Code (BGB). A contract that breaches a statutory prohibition can be void β and a void contract opens the door to reimbursement claims.
Online casino, poker and slots
Many casino, poker and slots claims relate to the period before Germany's newer gambling regime took effect around 2021. A key 2026 development is the CJEU's Lottoland decision (Case C-440/23), which confirmed that EU law does not automatically protect an operator simply because it held a licence in another EU country. National bans and licensing rules can still apply.
The argument in a nutshell
The operator had no valid German licence, so the betting or gambling contract was void β and the player can seek to recover their net losses.
